Visit by Participants in Training Course on the Enforcement of Intellectual Property Rights under the WIPO Funds-in-Trust/JAPAN
On December 4, 2014, participants in the Training Course on the Enforcement of Intellectual Property Rights under the WIPO Funds-in-Trust/JAPAN visited the IP High Court. The 24 participants from 12 countries, mainly in Asia, observed proceedings in actual cases and received explanations of the procedural steps followed in court. Chief Judge Ryuichi Shitara presented to the participants the general framework for judgment applied in cases involving trademark rights and design rights, and also provided them with the details of judgments on the specific cases. The participants asked many questions during a lively Q&A session, with regard to the topics addressed in the explanation by Chief Judge Shitara, as well as various other topics such as the enforceability of court rulings and the relationship between the judgment in first instance and the judgment in second instance.
