Visit by Participants in 2015 Training Course on the Enforcement of Intellectual Property Rights under the WIPO Funds-in-Trust/JAPAN
On December 3, 2015, trainees of the Training Course on the Enforcement of Intellectual Property Rights under the WIPO Funds-in-Trust/JAPAN (13 participants, mainly judges handling IP litigation from China, Indonesia, Malaysia, the Philippines, Thailand, UAE, and Vietnam) visited the IP High Court. The participants were provided with a briefing by Chief Judge Ryuichi Shitara on the judicial system and the patent litigation in Japan, and observed actual cases in court. After the observation, judges of the IP High Court provided them explanations on court proceedings, and also introduced the general framework for judgment and recent cases regarding trademark rights. The participants engaged in a lively Q&A session with Chief Judge Shitara and the judges of the IP High Court regarding a wide range of subjects, including the judicial research official system in Japan, the actual status of settlements, and legal issues related to the admissibility of injunction.
