Participation in INTA 2016 Annual Meeting
The International Trademark Association (INTA) is the global association comprising holders of trademark rights, trademark professionals and other members. The INTA Annual Meeting this year was held in Orlando, Florida, the United States, from May 21 to 25, 2016, and Judge Yasuhito Okinaka from the Tokyo District Court participated in the meeting. Judge Okinaka gave a report entitled “Calculation of damages in IP infringement cases of Japan”(PDF264KB) at the judges workshop in which Judge Manson from Canada, Judge Grabrucker from Germany, and Trial Examiners Grimstad, Ohm, and Wennermark from the Norwegian Board of Appeal for Industrial Property Rights participated. Judge Okinaka also participated in the panel discussion entitled “Free Speech and Trademark Law - A Discussion of Recent and Relevant Cases and Law from the United States, Norway, and Japan Concerning Speech, Expression, and Trademark Protection” in which Judges Moore and Stoll from the United States Court of Appeals for the Federal Circuit (CAFC), Trial Examiner Ohm from the Norwegian Board of Appeal for Industrial Property Rights and others participated under the moderation of Attorney Rachel. In this panel discussion, Judge Okinaka introduced the actual situation in Japan in relation to the recent court precedents in the United States.
