Visit by US Bar Liaison Council Members (October 18)

On October 18, 2019, nine members of the US Bar Liaison Council visited the IP High Court and exchanged views with judges of the IP High Court and the IP Division of the Tokyo District Court.
After the opening remarks by Presiding Judge Yoshiyuki Mori and Mr. Kevin Kunzendorf, Chair of the Liaison Council, Judge Daisuke Kumagai of the IP High Court gave a presentation concerning the Grand Panel judgment rendered on June 7, 2019, and then Mr. Fadi Kiblawi, a member of the Council, gave a presentation concerning how to calculate the amount of damages in patent infringement litigation in the United States. After that, Presiding Judge Tatsubumi Sato from the Tokyo District Court gave a presentation concerning the new evidence collection system and IP conciliation system, followed by a presentation by Ms. Nahoko Ono from the Council concerning the trends in US court rulings on patent eligibility. In the subsequent question and answer session, the participants engaged in fruitful discussion on the topics covered by these presentations.
