Visit by Members of the Department of State Law of the National People’s Congress of China

On November 19, 2015, 12 members of the Department of State Law, Legislative Affairs Commission of the National People’s Congress Standing Committee of the People’s Republic of China, including Director Wu Zeng, visited the IP High Court. The members received from Chief Judge Ryuichi Shitara and judges of the IP High Court detailed explanations on the outline of the IP High Court and patent litigation, particularly on matters in which the members showed keen interest, such as handling of the so-called “catchball phenomenon” in suits against appeal and trial decisions made by the JPO, the relationship between the invalidation trial system and the defense of invalidity, and measures taken to handle issues that arise from the existence of both systems. Further, the members of the Department of State Law asked many questions about the methods for training highly specialized judges and the human resource system of the IP High Court, and a lively Q&A session ensued.
