Meeting with Judge James Robart of the United States District Court
On July 24, 2014, Chief Judge Ryuichi Shitara and Judge Yuki Nakabu of the IP High Court visited the United States District Court for the Western District of Washington, and had a meeting with Judge James Robart.
Chief Judge Shitara provided an outline and explanation of the case decided by the Grand Panel of the IP High Court on May 16, 2014 (in which the court made a ruling on the permissibility to exercise a right to claim damages based on a standard-essential patent subject to a FRAND declaration, and determined the amount equivalent to royalties for a FRAND license). Judge Robart introduced Microsoft Corp. v Motorola, Inc., the case he decided on April 24, 2013, regarding a similar issue (in which the royalty rate for a standard-essential patent under a RAND commitment was calculated). The talk was very informative for both sides.
