CAFC Meeting with Chief Circuit Judge Prost of the United States Court of Appeals for the Federal Circuit (CAFC)
On July 29, 2014, IP High Court Chief Judge Ryuichi Shitara visited the United States Court of Appeals for the Federal Circuit (CAFC), and had a meeting with Chief Circuit Judge Sharon Prost and Judge Kimberly Moore.
Chief Judge Shitara provided an outline and explanation of the case decided by the Grand Panel of the IP High Court on May 16, 2014 (in which the court made a ruling on the permissibility to exercise a right to claim damages based on a standard-essential patent subject to a FRAND commitment, and determined the amount equivalent to royalties for a FRAND license). Both parties exchanged views on the recent CAFC rulings and confirmed that they would maintain their active exchange of information in the future.
Judge Moore explained the CAFC judge appointment procedure and the senior judge system. There were also talks about the difference between judicial research officials in Japan and law clerks in the United States.
