USITC IP High Court Chief Judge's Visit to the United States International Trade Commission (USITC)

On July 30, 2014, IP High Court Chief Judge Ryuichi Shitara visited the United States International Trade Commission (USITC), and had a meeting with Chairman Meredith Broadbent, Vice Chairman Dean Pinkert, and Commissioner F. Scott Kieff.

Chief Judge Shitara introduced the case decided by the Grand Panel of the IP High Court on May 16, 2014 (in which the court made a ruling on the permissibility to exercise a right to claim damages based on a standard-essential patent subject to a FRAND declaration, and determined the amount equivalent to royalties for a FRAND license). The parties talked about continuing to exchange information in the future.

Chief Judge Shitara also had a meeting with other USITC officials, including Chief Administrative Law Judge Charles Bullock and Administrative Law Judge David Shaw. Chief Administrative Law Judge Bullock provided information of the outline and current practice of the ITC procedures. Administrative Law Judge Shaw stated his view that, for judges in charge of intellectual property cases, being capable of acquiring a broad understanding of new technology was more important than having an academic background in a particular and outdated technology, and in this respect, having an academic background in the arts is not a disadvantage. The talk was informative for both sides.
