Participation in the International IP Court Conference hosted by the Patent Court of Korea (November 9 and 10)

  •  On November 9 and 10, 2022, Presiding Judge HONDA Tomonari and Judge KATSUMATA Kumiko of the IP High Court participated in the International IP Court Conference (IIPCC) hosted by the Patent Court of Korea.
     The IIPCC has been held every year since 2015 at Daejeon, where the Patent Court of Korea is located. Judges, lawyers, and scholars from Europe, the United States, and Asia attend the IIPCC and hold practical discussions on issues related to international intellectual property litigation.
     In 2020 and 2021, due to the COVID-19 pandemic, international participants attended the IIPCC by way of a video conference or video recordings. In 2022, however, some of the international participants visited Korea to attend the conference for the first time in three years, while others attended by way of a video conference or video recordings. From Japan, Judge Katsumata attended the conference in-person.
     Presiding Judge Honda participated in Session 4 "Damages Calculation and Procedures for Lawful Protection of IP Rights" as a panelist by way of a video recording, and introduced legal provisions and the situation of practices relating to calculation of damages incurred due to patent infringement in Japan. Judge Katsumata participated in Session 3 "Key Issues in Trademark Cases—Descriptive Mark, Distinctiveness through Use, Trademark Survey Evidence" as a panelist, introduced the actual situation and recent court cases in Japan concerning descriptive marks and the handling of surveys in trademark cases, and exchanged opinions with judges and lawyers of various countries.
