Participation in the 2022 Intellectual Property Judges Forum Held at the WIPO Headquarters in Geneva (From November 16 to 18)

  • From November 16 to 18, 2022, Judge TSUNO Michinori of the IP High Court participated in the 2022 Intellectual Property Judges Forum held at the World Intellectual Property Organization (WIPO) Headquarters in Geneva, Switzerland.
    The Forum aims to provide a platform for judges from across the globe to exchange their expertise on the most pressing challenges raised by the accelerating innovation and increasingly transnational use of intellectual property. Including online participants, 381 persons who are current and former judges from 99 countries attended the Forum.
    Judge Tsuno participated in the session titled "Judgment Writing in IP Cases" as a panelist. In this session, panelists gave presentations and a panel discussion was held with regard to the distinctiveness of an IP judgment and elements of a good judgment. Judge Tsuno explained the basic structure of a written judgment and preparatory proceedings to arrange issues and evidence in civil litigation in Japan, and actively exchanged opinions with other panelists on issues such as how to address infringement and validity claims in infringement lawsuits and who should be considered as the readers of a written judgment.
