- From November 6 to 7, 2024, the International IP Court Conference (IIPCC) hosted by the IP High Court of Korea was held at Seoul Special Metropolitan City, and Presiding Judge SUGIURA Masaki of the Tokyo District Court and Judge AMANO Kenji of the Intellectual Property High Court participated. IIPCC is an international conference that the IP High Court of Korea has held every year since 2015 by inviting judges in charge of IP litigations from participating countries as presenters. This year's conference was a large-scale one as the commemorative 10th conference.
Presiding Judge Sugiura took the rostrum in a panel discussion titled "Best Practices for Efficient Litigation Process." He introduced the characteristics of Japan's system, mainly regarding proceedings for patent-infringement litigations, in consideration of the changes in procedures in an advancing digital environment at each stage from the commencement to the completion of litigations, and participated in discussions based on a comparison of systems of individual countries.
Judge Amano took the rostrum in panel discussions titled "DOE: Approaches in Different Jurisdictions for Substantial Patent Protection" and "Emerging Issus in Pharmaceutical and Biotech Invention." He introduced litigation cases in Japan in which the doctrine of equivalents and requirements for patentability of pharmaceutical and biotech inventions are disputed, confirmed the similarities and differences in means of making determinations with other countries, and provided answers to questions from panelists from other countries.
