Participation in an International Symposium

  • On September 13, 2024, the Symposium regarding the European Unified Patent Court at Meiji University was held jointly by the Deutsch-Japanische Juristenvereinigung e.V., the Japan Patent Attorneys Association, the Japan Federation of Bar Associations, the Intellectual Property Lawyers Network Japan, the Intellectual Property Law and Policy Institute at Meiji University, and the International Association for the Protection of Intellectual Property of Japan. Chief Judge HONDA Tomonari of the Intellectual Property High Court, Presiding Judge NAKASHIMA Motoyuki of the Tokyo District Court, and others participated.
    In the Symposium, after the opening speeches by Chief Judge Honda and others, Judge Klaus Grabinski, who is the President of the Court of Appeal of the Unified Patent Court, delivered a keynote lecture on the current situations of the UPC, and a mock trial was held with Judge Grabinski playing the role of a judge.
    Then, Judge Grabinski, Presiding Judge Nakashima, and others took the rostrum in a panel discussion and conducted comparison examinations of the UPC and Japanese courts, based on the mock trial of the UPC, from the perspectives of [i] methods of hearing procedures, [ii] means for interpreting claims (consideration of publicly-known arts and application developments, etc.), [iii] procedures and effects concerning invalidation claims (existence or non-existence of binding legal effectiveness as to third parties, etc.), [iv] procedures for provisional dispositions, [v] cross-border infringement (territorial principle), and the like. Thus, lively discussions were held and participants deepened their mutual understanding.
